The Supreme Court directed to attach and sell benami flats of the Amrapali group in order to raise money for the completion of other stall projects. The court also said that this move will be beneficial for genuine home buyers. With this directive, those owning benami flats of the Amrapali group are likely to land in trouble.
The team of forensic auditors formed by the Supreme Court conducted the audit of all 46 companies of Amrapali Group, told a bench of Justices Arun Mishra and U U Lalit about the findings of many benami homebuyers. The team also informed about one particular case in which a person had booked seven flats in multiple projects of the Amrapali group but didn’t respond when they sought a response from him.
However, the bench of two judges said that all such benami flats are directed to be attached and sold to raise money. This move is will protect the interest of genuine homebuyers. Also, the benami properties can be set free to be sold out by this move.
The Supreme Court also directed the team of forensic auditors to make a list of benami homebuyers so that an appropriate order can be passed in order to attach such properties.
A total of 46000 homebuyers invested in multiple residential projects of the Amrapali group and this includes 170 towers in Noida and Greater Noida which are under construction.
Earlier, the Supreme Court directed attachment of Amrapali Group’s five properties that include a multi-Speciality hospital in Greater Noida, three residential towers situated in Sector 62, Noida and a villa in Goa.
