The Union Housing and Urban Development Ministry plans to hold a one-day workshop with homebuyers, banks and builders on November 15. This meet is scheduled with the aim to have an effective implementation of the Real Estate Act and most of the representatives in this meet will be from northern states.

An official also said that the participants from States such Uttarakhand, Uttar Pradesh, Haryana, Himachal Pradesh and Punjab, will have a discussion about the issues related to the legislation of 2016 in order to ensure proper protection to the home-buyers.

The RERA Act i.e. [Real Estate (Regulation and Development) Act] was bought into implementation by the Narendra Modi-led Central Government to enact rules and appoint regulatory authorities by all the states. The official further said that the home-buyers can also raise issues related to delay in delivery of flats in the workshop. The legislation provides for timely delivery of housing units by builders whose projects are registered under it.

The official was quoted saying, “It has been two years since the legislation was enacted by Parliament. We want all stakeholders — banks, regulatory authorities, home-buyers and builders — to discuss issues pertaining to its implementation.”

This kind of meeting was earlier organized in Pune and Chennai. Till now, 13 states and union territories have appointed a permanent regulator whereas 14 have interim regulators. The process to setup a regulator is midway in the flood-affected state Kerala. As many as 22 states and union territories have functional web portals under the law.

Till now 32,923 real estate projects have been registered under the legislation across the country and nearly 25,247 real estate agents have been registered under the same.

Apart from West Bengal, six northeastern states and Jammu-Kashmir, all states and union territories have implemented the RERA Act. The northeastern states including Arunchal Pradesh, Meghalaya, Manipur, Mizoram, Nagaland and Sikkim have not notified the legislation and its rules till now and this is because of land-related and other issues.

On the other hand, West Bengal has notified its own real estate act — the Housing and Industrial Regulation Act, 2017 (HIRA) instead of implementing the RERA Act. Although, Durga Shanker Mishra, Secretary, Housing and Urban Affairs ministry has earlier wrote to the State Government asking it to repeal its own act as there is a central law on the same subject.
