Gautam Chatterjee, Chairperson MahaRERA upheld the hearing of DSK group’s realty projects and ordered the complainants to approach the State Government for delisting the properties that are attached under the Maharashtra Protection of Interest of Depositors (MPID) in Financial Establishment Act, 1999.

More than 100 realty projects of the DSK group are lying delayed with the Maharashtra Real Estate Regulatory Authority (MahaRERA).

Chatterjee, in regard with the DSK Anandghan project in Haveli taluka said that the authority can’t make use of sections 7 and 8 of the Act to complete the balance work until the projects are delisted under the MPID Act.

In the order, MAHARERA said that in regard with the latest discussion that a majority of DSK group’s registered projects under MahaRERA are close to completion and a quick addressal of the issue at hand will offer possession of residential units to nearly 2,000 allottees. Hence, the MAHARERA in the interest of the homebuyers has required the State Government to delist the registered properties that are near to the completion.

Vasant Prabhu, Secretary MahaRERA said that till the delisting of properties, no order can be passed on forwarding the responsibility to complete the projects that are at advanced stage of construction to a third party or the association of allottees.

He also said that while the complainants’ rights remain as the allottees, these people should move to the State Government for getting the properties delisted prior to recommencement of the case hearing.

In the order, it is further said that while viewing the above facts at this stage, no orders can be passed for the revocation of the said project under the provisions of section 7 and 8 of the Real estate regulation and development act or any other provision of the act. It is, hereby, ordered that the complainants’ right as allottees in the MahaRERA projects continue to be protected.

The complainant was given the liberty to file fresh complainants at an appropriate stage. Although, the directive could not break the ice with the complainant, as he said that they are told to approach the State Government after a long wait as the general assembly election is approaching.
