The Manohar Lal Khattar-led State Government issued a notification which allows registration of fourth floors of plotted houses as independent dwelling units. This ruling bought smile to many property owners in the Gurugram city. Also, this notification is helpful for the property owners in the city as the residents were unable to sell the fourth floor as an independent housing unit due to non-availability of registry.
Earlier, in a meeting presided by the DTCP director general in March this year, the Department of Town and Country planning restricted registration of fourth floors as an independent residential unit. This decision was taken after HUDA [Haryana Urban Development Authority] upstretched the construction permit on private residential plots from a stilt and three floors (15m) to a stilt and four floors (16.5m) in February last year.
A K Singh, DTCP principal secretary issued a notification and said that the Government has allowed registration of fourth floors as independent dwelling unit and the terms and condition that as fees for permission to register, the owner will pay one-third of external developmental charges (EDC) applicable to a particular urban area, which shall be over and above the purchasable Floor Area Ratio (FAR).
The State Government further said that the permissible height of the building should be 16.5m, in subject to fire NOC and certificate of conformity to rules and structural safety. It also said that the EDC i.e. External Development Charges gained for registration of fourth floor should also be transferred to the respective agency that includes HUDA, GMDA, HSIIDC or MCG — to carry out EDC work.
The policy will come into immediate effect and that Department of Town and Country Planning will carry out all the necessary amendments in zoning regulations of respective development plans in Haryana Building Code 2017 and the maximum permissible limit of a residential building is 16.5m.
Haryana Chief Minister Manohar Lal Khattar said that earlier the government allowed the construction of a fourth floor, but didn’t allow its registration. We have directed the registration of fourth floor as an independent residential unit as the property owners in the city were demanding for the same from quite a while.
